Terms & Conditions OF SPECIAL ACTION "Refer Picodi to your friends and win!"

I. GENERAL PROVISIONS

  1. The present regulations define the rules of operation, as well as the terms and conditions of participation in a special action of a loyalty and promotional nature, called: "Refer Picodi to your friends and win!" (hereinafter referred to as , "Action" or , "Special Action").
  2. The special action is organized by Picodi.com S.A. with its registered office in Krakow (31-701), ul. Przemyslowa 12, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for Krakow-Śródmieście in Krakow, XI Economic Department of the National Court Register under KRS number: 0000551741, the amount of share capital 157 089,00 PLN (paid in full), NIP: 6762464586, REGON: 122849330, e-mail: cashback@picodi.com (hereinafter: , "Organizer").
  3. The Special Action is organized within the framework of and in connection with the Cashback Program conducted by the Organizer and the Referral Program conducted within its framework and addressed to persons who are their Participants under the terms and conditions specified in the regulations of this Program (Cashback Program Regulations). The Action is addressed exclusively to Participants residing in the territory of the Republic of Poland.
  4. The special action is a temporary action in accordance with the provisions of these Regulations.
  5. The terms used in these Regulations shall mean:
    1. Regulations - this document;
    2. Cashback Program - a promotional program conducted by the Organizer in Picodi, addressed to Picodi users;
    3. Picodi - an inclusive term for the infrastructure provided by the Organizer through which the Cashback Program is made available, depending on the market this may include, in particular, a website, mobile application, plug-ins or similar tools;
    4. Referral Program - a referral program conducted by the Organizer as part of the Cashback Program, enabling its participants to obtain the benefits specified in its rules;
    5. Cashback Program Regulations - regulations defining the rules of participation in the Cashback Program and the Referral Program, made available by the Organizer;
    6. Participant - Participant of the Special Action;
    7. Link/Reference Link - a dedicated link provided within the Referral Program for making referrals within the Referral Program i. The Reference Link is individual and assigned to a given Participant. In the case of Special Action Participants, the Reference Link will serve their participation in the Action in accordance with the provisions of the Terms and Conditions, including, in particular, the identification of such Participant for the purpose of participation in the Special Action.
  6. Terms other than those indicated in subsection 5 may also be defined directly in the body of these Regulations. In addition, other terms written with a capital letter have the meanings given to them in the regulations of the Cashback Program.
  7. In matters not regulated in these Regulations, the following shall apply: Regulations of the Cashback Program and Regulations of providing Services in Picodi - made available by the Organizer, as well as the provisions of applicable law. In case of conflict between the regulations indicated in the preceding sentence and these Regulations, these Regulations shall prevail.
  8. As part of the Special Action, Participants shall earn special points (hereinafter: , "Points" or , "Special Points") by participating in the Action on a competitive basis. Participants who earn the highest number of Special Points under the Action shall be rewarded by the Organizer, in accordance with further provisions of these Rules.

II. TIME AND PLACE OF SPECIAL ACTION

  1. Subject to subsection 2 below, the Special Action runs from: 29.11.2023 (from 00:01 a.m. on that day) until 31.12.2023 (until 11:59 p.m. on that day) - which means that during this time, Participants of the Action may collect Points under the Action, subject, however, to further provisions of these Regulations.
  2. The Organizer may extend the duration of the Special Action, which will be announced to Participants via announcements in Picodi.
  3. The special action takes place on the territory of the Republic of Poland.

III. TERMS OF PARTICIPATION IN THE SPECIAL ACTION

  1. Participation in the Special Action is voluntary.
  2. The special action is open to those who collectively:
    1. Have an active Account with Picodi and are Participants in the Cashback and Referral Program and
    2. Participated in this Action by selecting a dedicated functionality in Picodi - according to the messages displayed by the Organizer in Picodi.
  3. Persons who have fulfilled the above conditions are given the opportunity by the Organizer to obtain Special Points for activities in accordance with further provisions of the Regulations - using the Reference Link.
  4. In order to participate in the Special Action, the Participant provides his/her Reference Link, which is an invitation to register an Account with Picodi and the Cashback Program, to persons of his/her choice.
  5. When a person (hereinafter referred to as , "Referral Customer") to whom the Participant has provided his/her Referral Link by going directly from him/her to register with Picodi, the Participant will be able to receive Points under the Action for the following activities of that person:
    1. Realization of the first Purchase under the Cashback Program by a Referred Customer who has not verified the phone number in the Account in Picodi;
    2. Correct registration of an Account in Picodi by a Referred Customer who has not verified the phone number in the Account in Picodi;
    3. Realization of the first Purchase under the Cashback Program by a Referred Customer who has verified his/her phone number in the Picodi Account (verification according to the messages presented in Picodi);
    4. Correct registration of the Account in Picodi by the Referred Customer who has verified the phone number in the Account in Picodi (verification according to the messages presented in Picodi);
    5. Delivery of the installation and first login to the Picodi Plugin by the Referred Customer;
    6. Delivery of the installation and first login to the Application by the Referred Customer;
    7. Other activities entitling the Participant to receive Special Points under the Special Action may be indicated by the Organizer in Picodi.
  6. The number of Points that the Participant will receive for each of the Referral activities mentioned in subsection 5 above will be indicated on a dedicated subpage (Special Action page) within the website (picodi.com).
  7. Participant of the Action receives Points for the actions of the Referred Customer referred to in subsection 5 above at the time of their full and correct execution. In the case of Special Points awarded in exchange for making a Purchase - the condition for obtaining Special Points is that the Referred Customer places and pays for the order.
  8. Points under the Special Action will be credited to the balance participating in the Ranking hereinafter referred to within a maximum of 7 (seven) calendar days from the date the Referred Customer completes an activity entitling the Participant to receive a Point or Points.
  9. Special Points are considered to have been awarded as soon as they are recorded - credited on the balance visible within the Participant's Account in Picodi as awarded, from that moment special Points count towards the Participant's positions in the Ranking.
  10. Participants are entitled to make a complaint for wrongly charged or not charged Special Points, in accordance with further provisions of the Regulations.
  11. Special points are not exchangeable for money. Special points are not electronic money.
  12. Special points are assigned to a particular Participant by their assignment to his Account. It is not possible to transfer them between Accounts.
  13. If there is a failure to fully perform the activity for which they were to be awarded to the Participant in accordance with the above provisions - for example, in the case of abuse by the Participant or incorrect posting of the activity in question, the Special Points will not be awarded or will be canceled.
  14. As long as it is not otherwise stipulated in the regulations of a given Promotion, Participation in the Special Action and the purchase of Special Points under it shall not be combined with Promotions organized in Picodi.
  15. To remove doubts, the Participant shall receive Points for the activities of a given Referral Customer referred to in subsection 5 - only 1 (one) time - at the first of the activities of such Referral Customer.
  16. The Referred Customer does not become a Participant in the Special Action by the mere fact of registering in Picodi and the Cashback Program using the Referral Link or undertaking other activities in Picodi and the Cashback Program. However, the Referred Customer may become a Participant of the Action by himself/herself by fulfilling the conditions of the Action, in accordance with subsections 2 and n. above.
  17. The Referral Link shall be the same Referral Link provided under the Referral Program. A Participant who joined a Special Action and received Special Points for a given Referral activity shall no longer receive regular Points under the Referral Program for the same activity - unless expressly stated otherwise in Picodi. To the extent not regulated in these Terms and Conditions, the regulations for the Referral Link used under the Referral Program in the Cashback Program shall apply to the use and distribution of the Referral Link - in accordance with the Regulations of the Cashback Program.
  18. Points under this Special Action during the duration of this action recorded within the balance of the respective Participant. Information about the balance of these Points is available in each Participant's Picodi Account.
  19. The Organizer shall maintain in its system for the purposes of the Action a ranking of the Participants of the Action, in which it shall record information on the number of Points accumulated by individual Participants of the Action during its duration and thus the results of the Participants' competition for the Rewards (referred to for the purposes of these Regulations as , "Ranking" or , "Special Action Ranking").
  20. Information of Participants who rank from 1 (first) to 10 (tenth) in the Special Action Ranking is available on a dedicated subpage (Special Action page) within the website (picodi.com).
  21. Participant of the Special Action may cancel participation in the Special Action at any time by contacting the Organizer via electronic mail (e-mail) at: cashback@picodi.com .
  22. Resignation of the Participant from the Cashback Program is equivalent to cancellation of participation in the Action.
  23. A Participant who has opted out of the Special Action may rejoin the Action at any time, in which case Points are accrued for the actions of Referred Customers to whom the Reference Link was given from the time of rejoining the Action. Points earned prior to resignation from the Action are not reinstated.
  24. For valid reasons, the Organizer may terminate the Participant's agreement with respect to participation in the Special Action with a 14-day notice period. Valid reasons referred to in the preceding sentence shall be deemed to be the Participant's violation of the Terms and Conditions, the Cashback Program Terms and Conditions or applicable laws in connection with the Action. Termination by the Organizer requires indication of the reason for termination.
  25. The Organizer shall have the right to exclude from participation in the Share - after an investigation - a Participant who conducts activities that are reasonably believed to lead to attempts to circumvent the Regulations or the security and rules of the Share.
  26. A Participant who is a Consumer may withdraw from the contract of participation in the Action without giving any reason by submitting an appropriate statement within 14 days from the date of its conclusion. In order to meet the deadline for withdrawal from the contract, it is sufficient to send the statement before its expiration. The participant may formulate the statement on his/her own or use the model statement of withdrawal, which is attached to the Regulations. In the event of withdrawal, the contract is considered not concluded and the parties will make mutual refunds, which means that the awarded Points are canceled.

IV. AWARDS

  1. Participants of the Special Action who accumulate the highest number of Special Points at the time of its completion shall receive a prize (,,Prize") - hereinafter referred to as ,,Laureates" or individually ,,Laureate". The Organizer will award the first 10 (ten) persons in the Ranking with the highest number of Special Points, subject, however, to further provisions of the Terms and Conditions. Only Special Points having the status of awarded at the time of the end of the Action are taken into account in the Ranking. Completion of the update of the Ranking will be carried out by the Organizer within 3 (three) days from the date of the end of the Action, referred to in item. II of the Regulations.
  2. The Organizer has provided for Rewards as part of the Action, which constitute additional Cashback under the Cashback Program, which will be assigned to their Accounts in Picodi, under the tab ,,Tasks and Rewards". Rewards will be awarded to users who have earned a minimum of 10 points.
  3. The prize will be credited to the Participant's current Cashback Points balance under the Cashback Program and will be available for use by the Participant who obtained it only after the Participant has made cumulative Purchases of the required amount at any of the Organizer's Partner stores available at Picodi, in accordance with the further provisions of these Terms and Conditions.
  4. Bonus Cashback for taking the first place in the Ranking is ₹23,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹70,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date the additional Cashback (Prize) is assigned to the Participant's Picodi Account and no later than within 3 (three) months from the date they are assigned to that Account.
  5. Bonus Cashback for taking the second place in the Ranking is ₹15,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹50,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date the additional Cashback (Prize) is assigned to the Participant's Picodi Account and no later than within 3 (three) months from the date they are assigned to that Account.
  6. Bonus Cashback for third place in the ranking is ₹12,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹35,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) to the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment to that Account.
  7. Bonus Cashback for the fourth place in the ranking is ₹8,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹25,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) to the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment to that Account.
  8. Bonus Cashback for the fifth place in the ranking is ₹6,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹20,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) in the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment in this Account.
  9. The Cashback bonus for the sixth place in the ranking is ₹5,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹20,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date the additional Cashback (Prize) is assigned to the Participant's Picodi Account and no later than within 3 (three) months from the date they are assigned to that Account.
  10. The Cashback bonus for the seventh place in the ranking is ₹4,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹20,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) to the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment to that Account.
  11. Bonus Cashback for the eighth place in the ranking is ₹3,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹20,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) to the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment to that Account.
  12. The Cashback bonus for the ninth place in the ranking is ₹2,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of ₹20,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) to the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment to that Account.
  13. The Cashback bonus for the tenth place in the ranking is ₹1,000 and will be available for payment after the Participant who obtained it has made total Purchases in any store of the Organizer's Partner in the amount of₹20,000. The Purchases referred to in the preceding sentence must be made no earlier than on the date of assignment of the additional Cashback (Prize) to the Participant's Picodi Account and no later than within 3 (three) months from the date of their assignment to that Account.
  14. The Rewards referred to in subsections 4-13 above shall be awarded to Participants within 50 days after the end of the Action and subject to the fulfillment of the conditions referred to in subsections 4-13 above. If the conditions referred to in subsections 4-13 above are not met within the time limits specified therein, the additional Cashback (Prize) will be forfeited. In the event that two or more Participants of the Action achieve the same number of Special Points under the Ranking - they occupy the same place in the Ranking - in such case, the Organizer may reward more than 10 (ten) persons, and the list of Rewards assigned to a given place in the Ranking, as stipulated in subclause 4-13, shall not be changed.
  15. Information about the receipt of the right to the Prize will be communicated to the Laureate through a message in the Account, no later than 7 days from the date of the end of the Special Action.
  16. The Organizer indicates that the receipt of a certain number of Special Points and the related achievement of a certain position in the Ranking and thus obtaining the right to the Prize depends solely on the activities undertaken by the Participant himself. By participating in the Special Action, the Participant confirms that he/she is aware that the obtaining of the Prize is not determined by chance, but by the Participant's activity.
  17. Rewards are not exchangeable for their equivalent in money, or for Rewards of any other kind. Winners may not transfer the right to receive a Prize to other persons.
  18. Participants are not entitled to transfer the right to receive the Prize to third parties.
  19. The Organizer may request the Participant to provide his/her data necessary for the award or settlement of the Prize and details of its collection. The Participant forfeits the right to the Prize if the Organizer does not receive the information referred to in the preceding sentence or if the Participant fails to comply with the terms and conditions of the Regulations. In each of the aforementioned cases, the Organizer shall notify the Participant of the fact of losing the right to the Prize.
  20. In case the Participant loses the right to the Prize, it shall pass to the Organizer.

V. COMPLAINTS AND OUT OF COURT DISPUTES RESOLUTION

  1. Each Participant of the Special Action has the right to file a complaint, in particular regarding the incompatibility of the conduct of the Special Action with these Regulations. Such a complaint may be filed in a form chosen by the Participant, in particular in writing to the Organizer's address: 12 Przemysłowa Street, 31-701 Kraków or in the form of an e-mail message to: cashback@picodi.com.
  2. The complaint should include the exact details of the Participant and the reason for the complaint.
  3. The organizer will respond to the complaint within 14 days.
  4. The Participant may use out-of-court means of handling complaints and claims in accordance with the rules set forth at www.uokik.gov.pl under the "Resolution of Consumer Disputes" tab. In particular, the Participant may:
    1. obtain free assistance in resolving a dispute between the Participant and the Organizer, using the assistance of the district (city) consumer ombudsman or a social organization whose statutory tasks include the protection of consumers (such as the Federation of Consumers, the Association of Polish Consumers);
    2. submit your complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/.

VI. PERSONAL DATA

  1. The administrator of the personal data (hereinafter: ,,Administrator" or ,,Personal Data Administrator") processed as part of the Action is the Organizer, i.e. the company under the name: Picodi.com S.A. based in Krakow.
  2. Personal data are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119, p. 1), hereinafter referred to as: ,,RODO".
  3. The data controller processes personal data for the following purposes and scope:
    1. participate in the Special Action, including to the extent necessary to conduct it in accordance with these Regulations, select the winners, announce the winner and award the Prize, as well as to fulfill the Administrator's legal obligations imposed by generally applicable laws, including in particular tax/accounting laws. For this purpose, data such as name and surname, e-mail, and in the case of the winner, additionally data provided for the purpose of awarding the Prize - based on Article 6(1)(b) and (c) of the RODO;
    2. are processed.
    3. Finding, investigation and enforcement of claims and defense against claims in judicial and other proceedings, including enforcement authorities. Personal data provided by the Participant and other data necessary to prove the existence of a claim or which arises from a legal requirement, court order or other legal procedure are processed - on the basis of Article 6(1)(f) of the RODO - i.e. the processing is necessary for purposes arising from the legitimate interests pursued by the administrator or by a third party, where the legitimate interest pursued by the administrator is the establishment and enforcement of these claims and defense against claims;
    4. In order to process complaints, complaints and requests, and to respond to inquiries, data provided in complaints complaints and requests are processed, as well as in order to respond to inquiries contained in another form, as well as data on the cases that are the cause of the complaint, complaint or request, and data contained in documents attached to complaints, complaints and requests - on the basis of Art. 6(1)(b) - performance of the contract and (f) RODO - i.e. the processing is necessary for the purposes of legitimate interests pursued by the administrator or by a third party, where the legitimate interest pursued by the administrator is the need to guarantee the continuous, safe and uninterrupted operation of the business.
  4. The data controller processes the following categories of relevant personal data:
    1. Contact information of the Participant - including name, surname, address;
    2. Data on complaints, complaints and requests.
  5. Providing the Participant with the required personal data is voluntary, although it is a condition for participation in the Action.
  6. Personal data will be processed for the period necessary to participate in the Action, including the selection of the winner and the award of the Prize.
  7. Personal data will be deleted in the following in case the Participant to whom the data pertains requests its deletion or withdraws the consent given.
  8. Some data, in particular: e-mail address, name and surname, may be stored for the statute of limitations resulting from generally applicable laws or the period required by separate regulations (such as accounting regulations) - data processed for evidence purposes, processing of complaints, claims and for accounting purposes.
  9. The Administrator transfers personal data in particular to the following categories of entities: state authorities such as Tax Offices, prosecutor's office, Police, the President of the Office of Personal Data Protection - if they request it from the Administrator; accounting offices, partners, including the Administrator's staff, to whom the Administrator entrusts personal data in particular for the purpose of carrying out the Share and its settlement; to providers of services used by the Administrator, e.g. for electronic communication. The detailed list of suppliers is updated on an ongoing basis by the Administrator, and the data of entities to whom data is entrusted for the purposes specified above can be accessed by the Participant by contacting the Administrator.
  10. The aforementioned suppliers are primarily based in countries in the European Economic Area (EEA). The personal data controller may outsource certain activities to recognized subcontractors operating outside the EEA. Personal data transferred outside the territory of the EEA will be secured by appropriate legal safeguards so that the receiving providers provide guarantees of a high degree of personal data protection. These safeguards arise in particular from the obligation to apply standard contractual clauses adopted by the Commission (EU) or binding corporate rules duly approved by a supervisory authority within the meaning of the RODO. The manner of securing data shall be in accordance with the principles set forth in Chapter V of the RODO. The Participant may request from the Administrator additional information on the safeguards applied in this regard, obtain a copy of these safeguards and information on the place of disclosure. In addition, the Administrator will inform data subjects of its intention to transfer personal data outside the EEA at the stage of personal data collection. In some cases, the transfer of personal data may also be based on relevant decisions or agreements concluded with relevant EU authorities.
  11. Participant of the Action under the provisions of RODO has the right to: request access to his/her personal data, request rectification of his/her personal data, request deletion of his/her personal data (the so-called. "right to be forgotten"), to request restriction of personal data processing, to object to personal data processing, to request personal data portability, the right to withdraw consent; the right to lodge a complaint to a supervisory authority; In Poland, the supervisory authority under RODO is the President of the Office for Personal Data Protection (PUODO).

VII. FINAL PROVISIONS

  1. The terms and conditions of the Action are continuously made available, free of charge, by the Organizer in a way that makes it possible to obtain, reproduce and record its contents by printing or saving it on a medium at any time.
  2. The public nature of the Internet and the use of electronically provided services may involve the risk of obtaining and modifying Participants' data by unauthorized persons, therefore Participants should use appropriate technical measures to minimize the aforementioned risks, and in particular use anti-virus and identity protection programs for Internet users.
  3. Information regarding the Special Action will be communicated to Participants via messages in Picodi or sent via email to the email address provided by the Participant in the Account.
  4. When the Terms and Conditions are amended, any changes to the Terms and Conditions will be communicated to the Participant through information in Picodi listing the changes and their effective date. The effective date of the changes will not be less than 14 (fourteen) days from the date of their announcement. If the Participant does not accept the new content of the Terms and Conditions, he/she is obliged to notify the Organizer within 14 days from the date of notification of the changes to the Terms and Conditions. Notification to the Organizer of non-acceptance of the new content of the Regulations shall result in termination of the agreement effective as of the effective date of the changes to the Regulations.
